By accessing our website or engaging our services, you confirm that you have read, understood, and agreed to these terms.

- "Services" — estate planning consultations, probate and administration support, and inheritance dispute resolution, as described on our website.

- "Agreement" — these Terms and Conditions as updated from time to time.
- "Engagement Letter" — the written confirmation of scope and fees issued at the start of a legal matter.
2. Acceptance of Terms
By using this website or instructing us to act on your behalf, you confirm that:
- You are at least 18 years of age;
- You have the legal capacity to enter into a binding agreement;
- You are acting on your own behalf or are duly authorised to act on behalf of a third party;
- The information you provide to us is accurate and complete to the best of your knowledge.
3. Services
Kencana Waris provides legal services relating to inheritance and estate matters in Malaysia, including:
- Estate planning consultations, including will preparation and trust guidance;
- Probate and estate administration support;
- Inheritance dispute resolution, including mediation and representation.
Our services are available to individuals with matters connected to Malaysian law. We do not currently advise on matters governed exclusively by foreign jurisdictions. The scope of each engagement is confirmed in a written Engagement Letter.
4. Website Use
You may use our website for lawful purposes only. You must not:
- Submit false or misleading information through any form;
- Attempt to gain unauthorised access to any part of our website or systems;
- Use our website in a manner that could damage, disable, or impair it;
- Reproduce, distribute, or commercially exploit website content without our written consent.

5. Intellectual Property
All content on this website — including text, design, layout, and graphics — is the property of Kencana Waris and is protected under applicable intellectual property laws. 6. Fees and Payment
All fees are denominated in Malaysian Ringgit (RM) and are confirmed in writing before work commences. Our current starting fees are:
- Estate Planning Consultation: from RM 260
- Probate and Administration Support: from RM 670
- Inheritance Dispute Resolution: from RM 1,520
Additional costs arising from the scope of a matter (for example, court filing fees, disbursements, or additional attendances) will be discussed and agreed before they are incurred. Payment terms are set out in the Engagement Letter. We accept payment by bank transfer or cheque. Fees are generally non-refundable once work has commenced, unless otherwise agreed in writing.
7. Confidentiality
All information you share with us in connection with a legal matter is subject to solicitor-client privilege and our professional duty of confidentiality under the Legal Profession Act 1976. We will not disclose your information to third parties except as required to carry out your instructions or as required by law.
8. Disclaimers
While we take every care to provide accurate and thorough legal services:
- We cannot predict the outcome of any legal matter and make no representations about specific results;
- Website content is provided for informational purposes only and may not reflect the most current legal developments;
- We are not responsible for decisions made by third parties (courts, registries, beneficiaries) in connection with your matter.
9. Limitation of Liability
To the extent permitted by Malaysian law, our liability to you in connection with any matter shall be limited to the fees paid by you to us for that specific engagement. We shall not be liable for indirect, consequential, or special losses. Nothing in these terms excludes liability for fraud, gross negligence, or any liability that cannot be excluded under law.
10. Termination
Either party may end an engagement by giving written notice. If you terminate an engagement in progress, you remain liable for fees in respect of work completed to the date of termination. We may cease acting for you if there is a conflict of interest, if instructions are unlawful, or if continued representation would breach our professional obligations. Clauses relating to confidentiality, payment, and dispute resolution survive termination.
11. Governing Law and Dispute Resolution
These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising from them shall be subject to the exclusive jurisdiction of the courts of Malaysia.
In the event of a dispute, we ask that you first contact us directly at [email protected] to seek an informal resolution. If the matter cannot be resolved informally within 30 days, either party may refer it to formal proceedings.
Complaints about our professional conduct may also be referred to the Malaysian Bar Council.
12. General Provisions
- Entire Agreement: These terms, together with any Engagement Letter, constitute the full agreement between you and Kencana Waris for the relevant matter.
- Severability: If any provision is found invalid or unenforceable, the remaining provisions continue in full effect.
- Waiver: Our failure to enforce any provision does not constitute a waiver of our right to enforce it in future.
- Assignment: You may not assign your rights or obligations under these terms without our written consent.
- Notices: Formal notices should be sent to [email protected] or our registered office address.
13. Changes to These Terms
We may update these Terms and Conditions from time to time. The updated version will be posted on this page with a revised date. Continued use of our website or services after changes are posted constitutes acceptance of the revised terms. For ongoing engagements, material changes will be communicated to you directly.
